In the event of the UK leaving the EU, what can adult social care employers do to support and keep staff who are EU citizens?

A

Keeping EU workers if or when the UK leaves the EU in the event of Brexit is a key consideration for many adult social care employers.

Employers should ensure that staff who are EU citizens know about the EU Settlement Scheme. They should help them to apply if they need support.

The Settlement Scheme enables EU nationals to register for settled status if they have been in the UK for 5 years, or pre-settled status if they have been here for less than 5 years. The deadline for applications is 31 December 2020 if the UK leaves the EU without a deal, or 30 June 2021 if the UK leaves the EU with a deal.

The scheme is free. Applications can be made online at https://www.gov.uk/settled-status-eu-citizens-families

Staff and their families do not need to apply if they already have:

Settled Status means that the person can stay and work in the UK as long as they like. They can also apply for British citizenship if they are eligible.

Pre-settled Status means they can stay and work in the UK for a further 5 years. They can then re-apply once they have got 5 years continuous residence.

Applicants should follow the step-by-step instructions on the GOV.UK website carefully. A telephone helpline is available on 0300 123 7379 (+44 203 080 0010 from outside the UK). They will need proof of their identity and of their residence in the UK.

Staffing if or when the UK leaves the EU should form part of an adult social care employer’s business continuity planning. Plans should be regularly reviewed.
