Statutory Notifications of Incidents to the Care Inspectorate (Wales) Policy
Policy Statement
This policy shows how this adult care service complies with the statutory requirements to notify the Care Inspectorate (Wales) of incidents that have occurred in the running of the service.
Under Regulation 60: Notifications of the Regulated Services (Service Providers and Responsible Individuals) Regulations 2017 and the corresponding Schedules, care providers are required to notify the Care Inspectorate without delay (usually within 24 hours) using the respective online forms available on the Care Inspectorate website / CIW online the following:
A. Significant Harm of People Who Use Services
Any accident, injury or illness to an individual which, in the reasonable opinion of a health care professional, requires treatment by that, or another health care professional and has or may have resulted in:
- damage or impairment (either permanent or likely to last for more than 28 days) of the sensory, motor or intellectual functions of the individual
- changes to the structure of the individual’s body
- the individual experiencing prolonged pain or prolonged psychological harm
- the death or shortening of the life expectancy of the individual.
B. Running of the Service
Events that prevent, or could prevent the ability to provide a safe service eg:
- where there is an insufficient number of suitably qualified, trained, skilled, competent and experienced staff deployed to work at the service
- an interruption in the supply, to premises owned or used by the service provider for the purposes of providing the regulated service, of electricity, gas, water or sewerage where that interruption has lasted for longer than a continuous period of 24 hours
- physical damage to premises owned or used by the service provider for the purposes of providing the regulated service which has, or is likely to have, a detrimental effect on the care and support provided to individuals
- the failure or malfunction of the heating system in premises owned or used by the service provider for the purposes of providing the regulated service where that failure or malfunctioning has lasted for longer than a continuous period of 24 hours
- the failure or malfunctioning of fire alarms or other safety devices in premises owned or used by the service provider for the purposes of providing the regulated service where that failure or malfunctioning has lasted for longer than a continuous period of 24 hours.
Procedures
The service understands that where it is required to make any of the above notifications it must do so by an authorised person completing the applicable form available on the Care Inspectorate website/CIW online following the instructions found there.
The service recognises that where an incident has occurred that has resulted in the death of or serious injury to a person who uses services, which must be reported to the Care Inspectorate under Regulation 60 the service will also need to exercise its Duty of Candour in line with Regulations 12 and 83.
Training
Relevant staff are instructed in the service’s notification procedures, which involves:
- studying and understanding the latest Care Inspectorate guidance for making statutory notifications, as made available on its website
- knowing how to complete the correct notification form, making it clear who has made the report and their authority for doing so and the person who should be contacted by the Care Inspectorate.
