Searching Employees Policy
Policy
The company wishes to ensure that there is protection for its employees against any accusations made against them that question their integrity or honesty. In view of the fact that the company may carry on occasions, valuable and saleable loads of commodities, it is felt that there may be occasions when it would be useful and effective to search employee’s personal bags, vehicles and outer clothing should allegations be made against employees.
Procedure
The company must be notified of any allegations against an employee and a thorough investigation must take place as far as is reasonably practical.
The employee must complete an authorisation form, giving details of the consent to search, before any action to search is taken. (See Useful Documents Form UD23.)
An employee who refuses to give agreement, where there is a search clause in their contract of employment, may face disciplinary action for refusal.
Managers must obtain authorisation from ____________________ for each and every search, and appropriate form must be presented and the employee requested to give consent. A witness should be present during any search to safeguard the position of the employee and the searching officer.
The Manager authorised to conduct the search if permission is given must give clear reasons why this was done and record these reasons on the search authorisation form.
If any company property is found on the employee concerned then a senior manager should immediately be called. A statement will be taken from both the employee and the searching officer. Management action should be noted on the search authorisation form.
Following such a finding the company/senior manager will make a decision about the action to be taken against the employee and invoke the disciplinary procedure. Should the actions of the employee amount to a criminal offence the manager should consider whether or not to involve the police in the matter.
A copy of the search authorisation form should be kept on file and if requested a copy given to the employee.
